That would be a tough one. What was she convicted of? Murder 2?

If I walked in to what I thought was my apartment and I was carrying and someone was inside I'd be hard pressed not to start shooting.

There were only two people who know what really happened and how it went down and one of them is dead.

She's the only one who can say what she was thinking at the time. You have to judge her interpretation of what happened and what she was thinking.

Either way one person is dead and one's life is effed up. No good can come of this.

So basically, it looks like there is no question that any "hacking" of the lock or any misdeed by the management of the building has been long eliminated. The door simply "opened" one way or another.

Here is one article,
walked up to <the guy>'s apartment — which was on the fourth floor, directly above hers on the third — and found the door unlocked.

and another barely mentions it, but
she turned the doorknob

So either way, she either saw a crack in the door, or the door opened with a push of the hand, or she felt it's opening 'as if being unlocked' .. but yes, she'd know that she's opening a strangely unlocked door. Which becomes way weirder later when she doesn't notice the entryway or the 'cluttered countertop' or whatever. (not to mention the doormat outside)

Not sure what you mean. TX has executed three women in the last decade.

I live in a multi-floor complex and have twice accidentally pushed the 3rd floor on the elevator leading me to attempt to open the condo one floor below.

IT HAPPENS!!

I have also on two occasions heard someone try to open my door. I assume it is the same issue, but would have ended badly for whomever opened the door.

So I believe completely that she could have mistaken the man for a trespasser, and quite possibly we have sent someone to jail who doesn't deserve to be there.

I’d put something on my door that was acceptable, but different, to mark it. :dunno

This is a trained cop who showed poor judgement. Too busy sexting with her colleagues to realize it's not her apartment, and too trigger happy that she shot a dude eating ice cream watching TV.

Fuck that shit, hope she rots in prison.

While I can see being confused by a door that looks the same in surroundings that look the same, what are the odds their apartments were furnished and arranged the same? The whole excuse sounds a little implausible, thinking about that.

Well, I don't know about that. Assuming her mistake is legit, she still shot and killed an innocent man in his own apartment. She deserves some prison time, even if it's only a few years.

Wasn't she drunk or something?
