Bruh you KNOW you don't believe that. You KNOW it. Biggest indicator of future behavior is prior behavior. Everyone is trained on this like... You can't die in this hill. You know you're just coming off a big W and saying bs right now. Yeah everyone starts somewhere, but usually in their teens.
I've arrested probably close to 1,000 people in my career. I think I know what I'm talking about at this point...
Cases are made on evidence, not prior criminal history. In fact, prior criminal history cannot be introduced during a criminal trial unless it's related to the current charge (IE: To be convicted of being a felon in possession of a firearm, the prosecutor has to show the jury that the defendant was previously convicted of a felony, duh!). Otherwise, any introduction of prior criminal history is believed to taint the jury and must be excluded.
Additionally, having no prior criminal history doesn't mean that a person has never been arrested or committed a crime. It can mean several things. Think about the acronym "RAP sheet".
Record of
Arrest and
Prosecution.
If a person was arrested for simple battery under 243(a) PC and issued a citation to appear then released from the scene without ever being booked and fingerprinted, that arrest will not appear on a RAP sheet because they were not booked. If the DA does not file charges in the case, then there is no record of any prosecution. Thus, nothing from that incident would appear on the person's RAP sheet.
Or there could be juvenile offenses that would appear through a different criminal history check that is generally not accessed for adult defendants. Juvenile RAPs and adult RAPs are different databases and are not compiled together.
Or..... it can just mean that the person was never caught. Lots of crooks are in State Prison right now having been arrested for the first time.
The bottom line is the argument that Brown had no criminal history doesn't tell the whole story and doesn't mean much of anything.
