I preferred being at the mercy of the cop pulling me over and the "reasonableness" test. Now we are going to get a bunch of chickenshit guidelines that only outline how the tickets are written when you exceed some arbitrary parameter.
One step closer to ruining the last good thing here besides the weather and sooner or later those gov't dirtbags are going to mess that up too.

Better than making it illegal in my opinion. Now maybe other states will follow. California uber alles.

After looking at the text of the bill, it only says that the CHP can develop guidelines, it doesn't include those actual guidelines.

I'm assuming that they'll go with what they had when they had to take the guidelines down. So how long will it take for that to happen?

And for the few complaining about having actual rules to follow, I thought the previous CHP guidelines were totally reasonable and I would have no problem at all staying within those guidelines. But I'm not exactly a "power splitter" either, preferring to keep my safety as being much more important than getting somewhere a minute or two quicker.

And while case law will need to be established, I have the distinct feeling this will only help the cause of bikers who are unfortunate to be involved in an incident while lane splitting.

Sounds like the guidelines will be a team effort yet to come....

No, I think they're EXACTLY the same thing. For instance: nose picking. I pick my nose. A lot. Especially when I drive. It's not mentioned in the vehicle code. So is it legal? Or just "not illegal?" Isn't that a distinction without a difference?

Now, if I flick my boogers out the window, that IS explicitly illegal.

The "reasonableness" test will still apply, chickenshit guidelines not withstanding. Next time I see the Gov I'll relate that sentiment to him.

When the people of the United States of America or a lesser jurisdiction (state, county, city) want to modify a particular behavior they pass legislation that explicit prohibits it. So if there is no legislation prohibiting a specific behavior then it is 100% legal. Everything that isn't explicitly banned is 100% legal.

Sounds like what Vance Breese said to me once about the AFM rule book: "What is not prohibited is encouraged"

As others have expressed, this is completely inaccurate.

Anything not specified as illegal, is legal. This is why govts have had hard times keeping up with legalities around new technology.
