California to establish lane-splitting rules for motorcyclists
The bill, sponsored by Assemblyman Bill Quirk, D-Hayward, passed Thursday with a 69-0 vote. On the floor, Quirk said the proposed law had many positives, including reducing traffic congestion and promoting safety.

Quirk’s original bill proposed that lane splitting could occur legally only when a motorcycle was moving no more than 15 miles per hour faster than the traffic around it, and it prohibited the practice at speeds above 50 mph.

Several motorcyclists’ groups objected to that language, finding the speed limit too low. Other groups and individuals, who believe that lane splitting is dangerous regardless of the speed, objected to the proposal on principle.

The revised bill, which has sailed through the legislative process, provides a basic definition of “lane” and leaves the rest to the CHP.
I know that Budman has been keeping us updated on this bill for awhile.

I suspect they will first re-issue the guidelines that came out in 2012, which were quashed on "administrative law" grounds. Budman has immortalized those guidelines in the sticky thread Lane Sharing Tips.

I hope the the CHP look at the original Guidlines as a start.
I hope I can nose my way into the discussion because I have been on it since 2011.

I will be at CHP HQ in September and hope to get the full lowdown.

All in all. HUGE win for us. :banana and yes we opposed the speed limits, but support the guidelines.

HUGE!!!! Hopefully we will see a cascade across the country of other states joining in.
That assumes the Governor signs it. I believe he will. 100% in both the House and Senate.

Agreed.... Except I get that someone isn't cool with the enforcers making the rules. Who knows if it was even a motorcyclist.

For this case I can see why it makes sense but we have separation of government for a reason.

IIRC, CHP had fucked with that guy and he vowed to put CHP back in its place. Or something like that. He doesn't dislike or much less hates motorbikes. The guideline was one of the many means he had/has to get back at CHP.

If Gerry doesn't sign it, then both houses get to vote on it again. With unanimous support, they will override the veto. A smart governor would realize this, whether he liked the bill or not, and not waste everyone's time.

Actually I don't know if they will just roll those back out Dan.

I know they are going to set up a "team" to work with the CHP on the Guidelines so I kind of think they won't reissue the old ones. I am sure there is some posturing on who will be on the "team". AMA and ABATE would seem the logical top two. I am afraid my team of one won't have a shot :laughing

In all honestly the sooner the better though. We did see some positives when they were first issued and every day can make a difference. I would hope they would engage the public awareness portion almost immediately. A another great note the CMSP fund was just authorized to use an additional 1 million dollars a year for safety and awareness programs. I have been slowly working on a little write up to share about that since I just learned about it last week.

This is a huge win too. More on that later.

And Roger... Please man. I appreciate the love, but man your going over the top..:laughing :)

Awesome! I am glad to see the legislature is more accepting of motorcyclists and the CHP's advocacy of lane splitting than your average person.

This was in the Chronicle this morning. IMHO he'll sign it.
Oh, and I'm probably in the minority here, but I'm not opposed to a speed limit if the safety studies back it up.
