After documenting, including filming, contact the police. If he's done attacked with golf balls before, this isn't going to go well for him. If necessary, contact the city attorney directly.

I would try to resolve this through your HOA instead of involving LE at this point. It’s going to be impossible to prove that his golf shots were an attempt to hit you.

If you can’t achieve resolution through your HOA, perhaps involve Dept of Fish and Game regarding the golf balls in the pond and targeting the wildlife.

Other than that, I’m not seeing how this would be a police matter.

A citizen striking golf balls into a public area where another citizen is standing might be construed, reasonably, as an attempt to injure or threaten. Just as me hitting baseballs into a picnic area where you are sitting at a table might be seen as such. Or perhaps he should wait until he is struck.

there's no way hitting golf balls into a public area is legal. it just seems too dangerous. he's not gonna make it into the pond every time. hes not going to be absolutely certain that there arent people within range. etc etc. that can't be legal.

Whether something is legal is different than if it is prosecutable. I agree with Nick’s comment. Go through the HOA and Fish/Game folks but also document every instance thoroughly. If a golf ball hits you, that’s a different story obviously.

As long as we're stretching things, I'd consider assault with a deadly weapon. (245(a)(1) PC). But with the info provided, it's really weak case. I doubt I'd suggest to go that route if it were my call for service, and I doubt a D.A. would file on it either.

Video & date each incident. Make it show from the perspective of him in direct view of knowing you're in the vicinity when he's hitting the balls. It'll probably need to also show that he start hitting the balls AFTER he sees you walking, otherwise it could be easily interpreted as you walked into the vicinity while he was hitting the balls. So in other words, you were there first then he started golfing, not he was golfing first then you walked into the area. Just my opinion.

Yeah, it's not something I would call the police on, too iffy. That's why I want documentation. However, it would be nice, in the documentation, to submit a written report to the police detailing the incidents and circumstances. I've done documentation reports in Oakland just to have them on record. Here, there's no way you get the police out on anything short of murder or serious mayhem, other than maybe several days later. Understaffed.

Maybe it’s been a while since you guys have golfed at a public course. Plenty of balls stray into the direction of the general public and personal property.

Proving his intent was to injure is an impossible task, especially when the OP already said he hits balls into the pond as a regular practice.

There’s probably something there with the Fish Cops regarding hitting golf balls into the pond as it’s a natural habitat for wildlife. Local police aren’t the ones who would have any knowledge regarding that though.

OK, if i read your post correctly, you see him standing outside, arms crossed giving you the evil eye. Some time later you here something hit the water near you.
1. you did not see a golf ball hit the water.
2. you did not see who hit/threw/dropped something into the water.
3. you are speculating the entire event.

It sounds like you have issues with your neighbor and are looking for a reason to go after him. Past bad acts are not evidence. If you are going to make these accusations, I suggest you come up with something other then he was a child molester. Sounds like your trying incite the issue.
