neighbor hitting golf balls at me

Hi,
I am looking for some advice here. I live in placerville and our neighborhood has a private pond. I have deeded access to the pond, including an easement around the perimeter.

Last night I was walking my dog around the lake (GF was walking the other dog also). When we got to the area in front of one of the houses on the pond, this asshole was standing on his deck with arms crossed staring at me. I waved at him and he just kept glaring, obviously trying to intimidate me into leaving. I kept walking and about 30 seconds later a golf ball landed in the pond about 20 feet away from me (dude was a couple hundred feet away). I knew exactly what it was because there are golf balls all over the area and he is a big golf guy and I have seen him out there hitting balls before). I turned around and said loudly "Really?" and the guy was nowhere to be seen. I waited a minute or two, then left.

What are my avenues for recourse here? Is it illegal to hit golf balls into a pond? Was that assault? How can I deal with this situation, and I honestly don;t care about my relationship with this guy.

He is listed on the Megan's law site for sex with a minor under 14 and he has been busted for hitting golf balls at geese by CDFW already. Basically this guy is the asshole in the neighborhood.

I would report him again. I don't know if you have a HOA. A golf ball is essentially a deadly projectile.

There are several issues at play here.
1. I agree that the geese are a problem. As pretty as they are, we had three females lay this year. All were successful and now there are about 20 of them in the pond from this year's cycle. However, it isn;t his job to control them.

2. I am a biologist. I have an issue with him littering up my pond with his fucking golf balls.

3. I don't give a rat's ass if he needs to respect my schedule. Dude shouldn't have an issue with me at the pond, period. And to hit a golf ball at someone for being there, dude needs his face rearranged. But that is not my plan. My plan is to find a legal method to stop him from assaulting people, stop him from hitting his golf balls into the pond, and hopefully just get rid of the piece of shit.

Ya might take a different approach since you're a biologist and provide documentation to the neighborhood association of the detrimental effects of golf balls on the environment and wildlife. Cite laws and such that shows them that they need to dredge the pond maybe. It makes the whole thing a lot less personal. Once this dude starts costing them money, the situation might get resolved pretty quickly.

You have an easement? It is something historically deeded with your property, but it is really his property? There are golf balls all over. Thus it is obvious that he regularly hits golf balls there. And no one seems to care. Do you maintain your easement? Or are you just using it? Twenty feet is pretty far, if he was only two hundred feet away. Personally, I don't see much of a case. But, you can always get a cop to threaten him, I suppose. I don't know how often that would work, however. Maybe video tape of the "attack" is your best avenue at this point. Or better yet, figure out why you are pissing him off and work something out.

Let me clarify.

The pond is a private pond and everyone in the neighborhood has access to it. His house abuts the pond and he doesn't want people using it or "his" side of the pond. Fuck him.

In order to get to his house, he (and about eight other houses) use a road that is technically on my property. It is a paved road on an easement.

As far as the distance, he was about 200 feet from me. He hit a golf ball at me. It came close enough that I was bothered by it. Is it any different than throwing a rock at me or shooting a gun in my direction? It was obviously aimed at or near me.

Again, I have every intention on bringing this up either directly with him or to the police. The fact that he has already had CDFW come down on him for the exact same thing (using a golf ball as a weapon), I think I might get some traction.

Sounds like it's obvious that you need to talk to your neighbors/HOA/police and get everyone on board.

I'm not irritated. CS has a bit of a history of commenting without reading. Most of his questions were already covered in my original post.

I wasn't trying to be a dick. But I am looking for advice from leos, not opinions from the peanut gallery.

You are posting in a public forum. I offered sound advice and asked appropriate questions. If you want a private police opinion, you have two options: Go the the police, NOW. They will tell you what to do. You can then post about it here. Or hire a damn attorney and have him/her do something about your issue. To attack me, AGAIN, is just old. Put me on ignore, if you don't want to see my comments, or again - don't post in a public forum where people can comment.

Golf balls are not cheap, I would collect them as fast as possible. Plus, they are evidence.

As always. Document, document, document. You know the routine. Time of day, number of incidents, who is present, weather, the whole nine yards. Write a report. Photos are great, Videos are greater. A nice GoPro set up that displays him hitting and you being the target would be ideal. Once you've got that down, it's just rote work. You can start by filing a criminal complaint for assault, or having a lawyer send a letter, or just suing his ass. Up to you. I've done the paperwork more than once on neighborhood issues. This is a serious one.
