call the police every time the dogs get loose and cause havoc.

I'm going to totally avoid the guy. Only do certified mail or have papers served by a sheriff. I'm going to stay as mellow as possible and when I visit my parents, just drive by at 10mph and act like nothing happened. We are in the right and need to stay that way.

That would be my story too, and I'd stick to it.

I would also do whatever I could to have the dogs, if they are dangerous to the local community, removed by officials. Good luck, and I'm glad your son was not hurt worse.

sorry that this has happened. it seems crazy that there have been repeated issues with the dog and the county/animal control hasnt already taken the pet away

wonder if there is a rescue group you could call and they might be willing to take the pet from owner with consent.

My wife is picking up the CHP report today. I talked to a lawyer and he recommended mailing (certified) a letter demanding he give us his insurance info, if he has any. Then wait a week or so and follow with the small claims court. So, that's the plan for now. I'm enjoying all of the humorous responses and appreciate the serious ones.

Do you have comprehensive insurance, or UIM on the bike? If so, recover damages from your insurance company and let them go after the dog owner to collect. One of the biggest reasons to get good coverage is that it makes shit like this your insurance companies problem, rather than your problem. And the insurance company has a lot of resources and experience collecting.

If your son went to the doctor or hospital about the foot, that can bump the size of the claim up a lot, which gives the insurance company a bigger incentive to collect. Just be aware that any medical claim will attempt to collect from your auto insurance award.

^ this. Nothing else for you to do. If he has no pot to piss in, suing would be a futile exercise making only for more aggravation.

Tasers, bear mace, whatever you have. It's not animal abuse if the owner is negligent and the animals are hostile (this is in my personal lawbook, not the counties).

The dogs will leave you alone once they realize you are about that life...

Suggestion: Get the press involved. Nothing speeds the process of gov't officials than bad press. The dog owner is a bad guy. Makes for a good story.

Also, there must be some senior advocate agency that would represent grandpa.

Document EVERYTHING. Be nice, be patient, but be persistent.

Wrong. Do not involve the press, they have no incentive to be on your side and whether you are right or wrong they might decide the old guys story is better than yours. The press are NOT the good guys.

Your recent comments are best...do not antagonize or confront directly, do not hurt anyone or anything - be the good guy that you are and you will prevail, eventually. It will take a long time, but those dogs will be contained if you use the system methodically.

Unfortunately we only have liability ins. They won't help because it's a comprehensive claim.

I think your most immediate course of action is to bump up your insurance. Even with good medical coverage, incidental expenses can be tremendous. I strongly recommend a decent comp policy (even with a high deductible) and good UIM coverage (UIM is critical. I recommend at least $250K per person. I personally carry $1M UIM.)

Financially, you're very exposed on a motorcycle. Bikes get knocked over all the time. Deer pop into the roadway. Other drivers might not see you. No one carries enough liability to cover your losses in a major accident.

Most no-kill shelters won't accept every dog they're offered. If they don't have room for another dog, they won't accept another dog. If the shelter is full they usually have a list of other no-kill shelters, breed-specific rescue organizations, and good citizens who might be willing to foster a dog in order to prevent it from being euthanized.

The local cat shelter has a farm where they ship the cats that aren't adoptable. We actually got one of our cats from there rather than the shelter itself.

He called me this morning nice as can be and gave me all of the insurance information. Promised to take care of the dogs and apologized for the situation. I think this is the best possible outcome at this point. No lawyers needed and no drug out court process. If he finally contains the dogs, then all should be good. I've been out to my parents twice since then and have seen no dogs, and neither have my parents. Time will tell on the dog situation.
My son will be upping his safety gear and I will increase our insurance. I hope everyone that has read this can take something away from it, both as riders and animal owners.
