if someone try to break in to your car in front of your house,can you go out and hit that person with a bat?or call for a leo?but calling a leo will take time before getting to my place and, the thief will be gone by then..i ask this cuz,someone did trying to break in to my cager last.

I would say the best thing to do is call the police first and give them a very good description of the person who seems to breaking into your car. That way at least cops know who to look out for if he runs or something.

I would you probably dont want hit the guy because for one, you dont if the guy is carrying a knife or a gun or something so it jsut dangerous on your own part. If you have a gun, then I might say maybe you can go out and tell him to get on the ground.. but again he might run or rush you. you don wanna get in a bad situation.


but I will wait for some cops to give the expert advice.

You're sitting in your house and someone is trying to break into your car? No, you cannot go attack them with a bat or start shooting. You'll end up in far deeper shit then they do.

You don't know if the guy is high or crazy, carrying a weapon, or what. Besides, it's just a car. Regardless of what you think of the guy, a car isn't worth getting hurt or killed over.

I caught an auto burg a few weeks back by calling the cops. The guy was breaking into my car. I walked outside as I was calling 911. During the call, the guy broke into two other cars right in front of me. The cops came, I told them where he ran off to, 10 minutes later I was doing a cold show.

He ended up pleading guilty. Case closed.

be a good witness, plates, description of suspect, and or vehicle. IF the guy does not pose a threat you cannot do jack sh*^t. Last thing you want is to get sued and go to jail. correct me i im wrong (leo's) you can pull a gun to protect property but if the guy runs let him run. you can only squeeze the trigger if your lie is in danger.

Theoretically a citizen's arrest allows you to use force. Just don't complain when you get your ass sued off. Call teh popo.

I do hate the "It's just a car" or "It's just a wallet" or "It's just a <insert some type of property>" comment though.

People work damn hard for their property, and some risk a lot everyday during that "work." I should be allowed to protect it at all costs.

However, this is California, and you're not allowed to. So in this case, call the cops. :)

yeah. most of the people got it right. call the police, let them know its in progress, provide a detail descrip of the guy, race, height, age, weight, what he's wearing, anything distinctive that would show up (ie orange shirt or something ya know?). the dept will send units pretty quick for a crime in progress.

but u should probably get your city direct 911 line for cell phones. if you dont, then u go to chp.. explain... then they transfer... then u got to explain again, and that wastes a lot of time.

Thanks for the respond guys..well i didn't exactly saw the person,but my inlaw did, she said someone was trying to open the passenger door.i guess that person saw her and ran..that's way i ask what can you do next time,if this happen again.and you guys are right charging with the bat,it's just gonna put my self in big shit.hmmmppp Paintball gun:D...

One more thing to add. I say this as I use to live in Calif. If you have a dog, don't set the dog out after him. You will get sued for more than your car is worth. Trust me on this one.

Paintball gun could get you killed just as easy.

Now isn't there something in the law that allows you to stop someone committing a felony? Since the car is worth over $500, that qualifies, right?

And what if, by losing your car - you lose your living(as a driver or something)? Can you shoot if you are protecting the income that supports your family?

And you don't know whether or not the bad guy will steal the car and perhaps use it as a deadly weapon against you...

In CA - it seems no, you can not.

I like this idea... call the police first, get them on their way, and if the criminal starts to leave before the police arrive, tell them to look for the guy with paintball marks on his ass...:teeth
but yeah, on the serious side, I agree with T-1 Thunder, it could also get you killed:(

I'd call the cops, then take some pictures or video through a window and try to avoid attention. If he ends up leaving, hopefully you get enough to identify him, and if not, then at least it's pretty damned good proof for your insurance company or whatever.

Speaking as a layman...

In this case, the poster witnessed a public offense and could have placed the man under citizen's arrest using a reasonable amount of non-deadly force.

Personally, I believe the only time deadly force is authorized is when you are in fear of losing your life, or you are protecting the life of another...or are stopping an in-progress violent felony. In this example I don't see how deadly force could be deemed reasonable unless the subject attacked the arresting citizen and that citizen was in fear of his life.

One thing's for sure, if you shoot someone, regardless of how justifiable the shooting is, you better be ready to go to jail for a little and have a lot of money in reserve to hire a good lawyer.
