I'm just cynical about this working out. The insurance company was not operating the vehicle and probably had the right paperwork to put the liability on the renters who signed all that. Sounds like it would be sue and fight in court, a big rental company I assume. I'd be surprised if Geico did anything except raise any future premium.

Why? Nevada is a mandatory insurance state. The rental company is legally required to have some kind insurance... Either to cover themselves, the driver, or both.

Any recommendations on a lawyer? My hunch is that insurance is staring me down, but will see. I think I will wait for NHP accident report to be finalized before I decide if to dump it or keep it till all this gets sorted out.

Oh yeah. First ever accident & that too something like this. Kids were crying, but so thankful that nobody ended up in hospital.
A very kind lady two cars behind us helped move all ski crap into her car & drove us to Reno for a rental car. I don't know how we were so fortunate in many ways that day 🕉 !

That's awesome to get a little help from a stranger. Keep an eye on the fam for a bit. It's a real loss of confidence in the safety of your surroundings and kids especially can suffer from that.

Why wouldn't they just leverage their legal counsel to dick around endlessly, ignore, and stall?

I've played enough with insurance claims enough in this state to know they manipulate the system and know a whole ell of a lot more about how to gain advantages than the average joe, like determining the other party is at fault and deny any claim. There was a story here about that despite the police report.

Here's your problem. The rental agency doesn't directly owe you squat. They potentially owe the foreigner, IF the foreigner gets sued by you, and counterclaims against the agency/agency's insurer. So you have to sue the foreigner, who has now pissed off and returned to a foreign land, in Nevada courts. Got a good idea of how to serve that foreigner?

Hire a lawyer and you'll be $5,000 in the hole before things even get started. And no, you won't get to claim those legal fees as damages.

Rodr's advice is common, from people who are smart but don't understand the law. They think it's this crazy complicated thing that only the high priests of law (lawyers) can understand.

Here's another option. Sue the rental company anyway, and try to bully them into settlement. It might work since you aren't really asking for much.

$1000? I'd personally just try to get the rental company to make me square. If they don't I'd probably just chalk that to the game. What's your time and effort worth? Certainly $1000 isn't worth hiring a lawyer unless you're just on some principality shit.

Yeah, they're claiming they don't owe you anything and it sounds like they washed their hands of doing anything.

They have the resources to get traction with the rental company, and I guarantfuckingtee it that if you sued and got money, they'd want a piece of that.

I've dumped long term agents when they don't help me out in situations like this.

Because he's probably paying over $100/month to be covered. He's probably been paying for years.

You buy insurance so that you don't get into situations where you are S.O.L.

I we let them just say 'Sucks to be You' with zero help, they'll keep doing it.

That's the thing, he doesn't have that coverage though. He chose not to get full coverage.

I understand the frustration, but you don't go to the gas station, pay for 87, then get mad when they don't give you 91.
