selling a vehicle w/owner not present?

i'm helping a friend sell a vehicle while they're out of the country.

let's say i find a buyer; what can i do? looks like it's $50-$100 each way to mail documents (e.g. the title) quickly (under a week, with some chance of it being lost in the mail). a fax or email is ~free, as is signing on their behalf--but i don't know if either of those are valid.

1) you have seller sign and NOT date the title in 2 places required
2) have seller give you a dmv power of attorney
3) have seller sign second dmv POA that is blank and you can put the buyers name there when the buyer pays.
4) have seller sign a dmv bill of sale

if they're not already gone I think the power of attorney form is the way to go. IIRC you can't download, need to get original from DMV (or maybe AAA).

Bingo. Make sure to do the Bill of Sale/ POA on the original REG262 form (not a downloaded form). You can get these at the DMV. Get a few.

The buyer may be sceptical. I had somebody sell me a vehicle not in his name. I told him the only way I would complete the purchase is if he went to the DMV with me to transfer the title. He did, and we completed the sale.

the DMV POA form is what i needed to know about. looks like that's available online, so sending it one way (he prints and mails to me) is easy.

the trick is that the title is... who knows where (the owner apparently doesn't, sadly that's what i figured). so that adds the lost title form... which again is simpler (he prints and sends) except for the part about finding a notary in a foreign country. the us consulate can do it but may not have time until july.

the vehicle is 13 years old so no reg 262 is required, right?

yes, the buyer will be skeptical. but this is an unusual (though not rare) vehicle offered at a good price for someone who wants a project.

I bought a bike with an owner not present, his "cousin" was selling the bike. I had him call the actual owner and text us a pic of his license which he had no problems doing. No harm no foul.

I ALWAYS get an original reg262 and have the POA done on it. They won't accept the printed ones, many times. They want the official reg262 manila form that you have to get from the DMV directly. Sometimes, you're ok without it, other times, not. I always get one (and I do about 10 deals a year). I'd suggest getting a reg262 filled out with POA. Don't fill out who the POA is to, leave that blank. Just have them sign it.

I'm sure you know this, but they may not; the POA is only relative to the vehicle on the reg262 (hence the reason its on the same form and the printed one from the net doesn't work consistently). It does not need to be notarized in the state of CA. Send it US mail and they can send it back US mail. Or Fed ex. I fed ex everything.

Without a title, my suggestion is to have the current owner write a bill of sale to you.

You go get a title in your name

The sell the bike.

Deduct the cost of the taxes and the title transfer from current owner to you from the sale proceeds and then send owner the remaining $

It will take longer but the process will be much less "hokey" and you will get more for the bike.

No title document and no owner available, aaah the plot thickens...

the owners is pretty thick.

(actually no he's not. just disorganized. easily reachable, just hard to move documents across an ocean for a reasonable fee and timeframe; worst case he'll be back in town in July. but i hope it's sold before then.)

Yay owner is back in town this week! I've had lots of lookers, and one serious offer... who couldn't execute because of the paperwork issue.

Another question:
Let's say the buyer is from Nevada. It looks like they (and the seller) should still complete out the California Reg 227 (Duplicate Title) form, which will cause the title to be mailed to them in Nevada in 2-4 weeks.

Does that sound right? It should have their name on it and everything. They can also bring all the other California paperwork with them (reg 135 bill of saile, reg 260 power of attorney) to the NV DMV. They are responsible for all the Nevada paperwork, not the CA seller.

What kind of a percentage are you making? My standard was 10% when I sold Someone's bike for them.

Seems like a lot f BS unless the bike is $10,000+.

it's for a friend. he's offered me a nice percentage, but i plan to only take my costs (which are not zero) since i can afford the time and money more than he can.

(and it's not a bike. it's a bus. anyone want a bike-hauler?)

grr.. looks like the reg 227 form (lost title) only needs to be notarized if there is a 'legal owner'. which, since there's no leinholder, there is no such thing, only 'registered owner', right?

could have had this sold weeks ago w/o the notary constraint....
