Passing car on the right

A bicycle that is.

This SUV was too damn slow on a one lane road to the point a bicycle got impatient and tried to pass it on the right several times. (I think) the driver just didn't realize the bike was next to him and closed the door on the biker two or three times. Finally the bicycle made itself through and the driver was like "oh shit", moved nearly half way onto the opposing lane, and almost came to a stop in front of me. At which point I (im)politely gave him a honk to tell him to move the fuck back to his lane and keep on driving.

Let's say if the car creamed the bike, who would be at fault? Driver? Biker? Or me, because I was just lugging behind watching and doing nothing?

I have it on the Contour but am too lazy to cut the part.

Passing on the right is generally the less desireable move, but sometimes it can be the least dangerous path.
