if you look closely, looks like the moto guy was coming from the right lane to the left lane and the car struck him. i'd say it was the moto dudes fault.

It is not the moto's fault. That is a high speed road. The car on the shoulder pulls into traffic causing the car in front of the bike and the rider to slow down, but the driver behind him was not paying attention.

The rider looked like he was headed towards the shoulder to pull off. He apparently changes lanes without seeing the minivan idiot coming up from behind on the gas. He gets hit from behind at a pretty sizeable speed differential. I say they both share responsibility- 2/3rds goes to the minivan driver not paying attention to what is going on in front of him. 1/3rd of it goes to the rider for not fully checking out the entire lane before entering it.
