Legality of taking political signs...?

Hey guys...question for ya.

Is it illegal for me to take down political signs on public property (say, in the grassy area next to a freeway? or next to an on-ramp?)

These fucking yes on prop 8 signs are everywhere and i've had it.

If its private property i.e. state owned, you get trespassing, theft and, whatever else a cop can drum up. Any warrants before you go?

Good question. It's clearly illegal to remove signs from people's private property, so I guess the real question is whether it's legal to post those signs in public areas.

If it is, then it's clearly illegal (not to mention rude) to remove them. If not, then you can 'clean them up' under the guise of fighting litter. :thumbup

Regardless, the best ways to fight Prop 8 are:

- vote against it
- tell everyone you know to vote against it
- donate to the No on 8 campaign
- put up some signs of your own.

Would that be a conflict of interest, though? I mean, state property allowing posters of one side but not the other?


I think campaigns have 2 weeks after the election to take their crap down. After that they could be cited for littering/vandalism. At least I think those were the rules in Stanislaus County as I remember them.

Political signs are my pet peeves.

Most political campaigns never go back and pick up their ^&@#(^$ signs after the election, so I have very little sympathy for them when people steal them before the election!

I'm a believer that campaigns should be fined $5+ per sign left up longer than 1 week after an election (or maybe they should get the standard littering fine!) so that we don't have to look at this trash for weeks or months following an election. :x

Selectively pulling down a political sign simply because you disagree with the position is wrong, IMO, regardless of whether it is legal.

they do get fined... if u are really that put off, call in after the allotted time and hopefully they will get dinged

Please provide a link to support this, I couldn't find anything about it.

I found plenty of places where people got fined for taking down or changing political signs but nothing about the campaigns getting fined for not taking them down.

public property is NOT private property an it IS ILLEGAL to put up signs on freeway overpasses and yes you may take them down. It is illegal to put up political posters on public property.

CHAPEL HILL, N.C. – Shawn Turschak of Chapel Hill was tired of someone stealing McCain-Palin campaign signs from his yard. Turschak, with a degree in electrical engineering, hooked up a third sign to a power source for an electric pet fence Monday and also put up a surveillance camera.

The News & Observer of Raleigh reported that a 9-year-old boy with an Obama-Biden sign grabbed the McCain-Palin sign and got a jolt on Tuesday.

The boy's father, Andrew Noble, upset that his son had been shocked, showed up at Turschak's door. Soon an Orange County sheriff's deputy also showed up at the Turschak's home.

Noble said his son just wanted to see how the sign was put together. Turschak said the boy intended to swap out the signs.

Sheriff Lindy Pendergrass said he doesn't plan to file charges.

Arrests made in Roseville after Yes on Proposition 8 signs found in car

Roseville police arrested a man and two women early today who were reportedly stealing "Yes on Proposition 8" signs from residents' yards.

Officers recovered 53 signs from the suspects' vehicle - all in support of Proposition 8, said Dee Dee Gunther, police department spokeswoman.

The arrests occurred about 12:32 a.m. after a resident in the 200 block of Sierra Boulevard spotted someone taking a sign out of a neighbor's yard.

A few minutes later an officer spotted a green sedan, matching the description of the suspect vehicle in the 700 block of Shasta Street. All four doors and the trunk were open and the officer watched as two people walked to the car and placed something in the trunk. The car then drove away but was stopped by police.

Police arrested Brian Joseph Greene (left photo), 18 of Roseville, Kacey Elizabeth Flieder (right photo), 18, of Sacramento and a 17-year-old girl from Roseville. The 18-year-olds were booked on suspicion of possession of stolen property, conspiracy, petty theft and contributing to the delinquency of a minor. The 17-year-old was cited and released to her parents.

Karen England, a local coordinator for the Yes on 8 campaign said theft and vandalism of Proposition 8 signs has become a continuing problem. In some cases, signs have been stolen multiple times. Proposition 8 backers along Misty Creek Drive, off Foothills Boulevard, have started bringing their signs in at night but recently they also have experienced spray paint vandalism as well as sign theft.

"This has been happening all over Roseville," England said, noting that she has filed two police reports related to theft of signs from her yard. Her organization recently posted a $1,000 reward for information leading the arrest of sign thieves and vandals, England said.
