Facial recognition software leads to false arrest

This is the stuff nightmares are made of. We’re seeing an ever increasing use of this technology creep into the mainstream. We’re told about it however we aren’t told where and when it’s happening. Apparently Apple is using it.

Part of me thinks these devices need a label on them warning the public of what it’s doing. Scary tech which is already showing us how it can used against us.

What do you all think of this tech and the article?

All I saw was some teenager suing Apple for one billion dollars, because he was wrongly arrested.
A billion? :wtf me thinks he is a bit of a snowflake.

Mistakes are inevitable, but I have little issues with technology for solving crime.

You’re right a B is a lot of money but I think it’s more of a lightning rod than an actual number.

I get that $1B is a huge number; what do you think is appropriate for a grand theft arrest record that will follow you as you try to get employed?

Honestly not clear what the bases of his claim are. Sounds like thief used ID he lost, Apple had regular security cameras.

This is just fear mongering click bait, basically.

The lawsuit says an NYPD detective determined that Bah had been wrongfully arrested, viewing surveillance footage from the store and seeing that the suspect looked "nothing like" Bah.

And

The detective also suspected that the real thief might have used Bah's driver's permit, which he had lost, as ID during one of the offenses, thereby linking Bah to the crimes in Apple's systems.

This is just identity theft. Police might not have had access to a photo of the teen prior to obtaining an arrest warrant, but once arrested, the detective determined the suspect was not the same person as the teen.

All Apple facial recognition did was connect a supposedly identified suspect in one case with cases from other stores. This is often done among businesses, but obviously, doing it the old fashioned way isn't going to be as efficient. So, without facial recognition software, the teen might have only been implicated in one theft, rather than several. Either way, he might have been arrested, and either way cleared by the video.

My bet is this lawsuit had no merit and his nowhere.

Here's how it likely went down. The suspect identified himself as the teeen, using his lost or stolen driver permit, during a transaction, say in Boston or something. That store then determined the suspect stole items so they made a police report and flagged the facial recognition profile in their surveillance system.

Then, when the suspect went on to steal other items in the Manhattan, and other stores, Apple called the police, made a report, handed over the video, and told police the suspect had been identified as the teen in a prior case in Boston, and they knew this because the profile matched their facial recognition software. So, NYPD took a report and got an arrest warrant. Then a detective later determined the teen was not the suspect.

NYPD should have confirmed the identity of the suspect before seeking a warrant. Can't say why they didn't do that. But it does sound like Apple's facial recognition video did the job it was supposed to do correctly.

If he wins the suit, won’t the record be expunged? :dunno
One thing win win a suit, to be made “whole” again, another thing to take advantage and profit.

From what I understand, the arrest stays on your record along with the outcome (dismissal, acquittal or conviction). IANAL or a LEO though, so I've probably misunderstood something in this.

I do think you’re right about that.
I would think if that happened, false arrest, that you would be able to get a letter of clearance, from the PD, for future reference. I don’t know, I have never been arrested, I mean I never been caught :laughing
