thought duc litearlly was challenged and gp tech said it was legal because it wasnt mounted to swingarm and actually to the frame/fairing

It’s very clearly mounted to the swingarm.

I think that is the basis of Ducati’s argument. Aero rules only apply to the fairing and fender. Since this is mounted to the swingarm, aero restrictions do not apply.

Also, it’s for cooling the tire *wink wink*, but it’s also not for cooling the tire, but they can’t tell you what it’s for, but it’s for cooling the rear tire.

Interesting. I wonder if there was some minor difference between Aprilia's device that was ruled illegal and Ducati's device which is now ruled as legal.

I read it wrong

By mounting the 'cooler' on the swingarm, Ducati avoided the MotoGP 'Aero Body' rules, which limit each rider to one fairing update during the season.

Ruling stands, spoiler is legal, not sure wtf they were thinking this pr stunt was going to over rule the technical directors decision???....

...so that it scoops up air and directs it onto the tire. Definitely not for downforce.
