I voted "racing incident" because I don't think Herrin had any idea he was going to hit another bike's brake lever.

Can't say I see any negligence or foul play on that crash.

Can they just chalk it up to super close elbow banging tight racing action and call it a day? Or someone has to take the blame?

The general rule is that the person in front has the right of way and you can't actuate someone's brake lever from behind.

or that since josh was in front (since you can't actuate someone's brake lever from behind), he had the right of way, and was free to actuate westby's brake?

Looks like bad luck that he happened to bump the brake lever. At the speed it went down you couldn't see that sort of thing coming.

edit, hah, I thought of bark busters too. It's not like he reached over there and grabbed the lever, come on.

+1 not a bad idea.

Looking at the vid again it looks like the rider gets two shots with his elbow at the front brake and makes contact on the second try.

You think he did it intentionally? The only reasonable thing to do with someone who really did something like that would be to put them in prison. Basically the level of whipping out a knife in a boxing match.

If someone is crowding you, you might well be inclined to stick out an elbow to buffer contact without any intent to hit a brake lever. Saying that the action is evidence of intent is based on the assumption that hitting the brake lever is the only reason why someone in that position would stick out his elbow. I don't think that assumption always holds.

racing incident which could have been avoided with a protective bar over the brake. I'm surprised this isn't a safety regulation considering the amount of front brake high speed endos that have occurred from race contact.

Lets get in his head "if I bump this guys front brake at 160 mph I can take him out and pick up a place w/o worrying about the consequence of the splatter factor?"

Please. He dropped as was needed to get a good line, likely expecting other riders to do the same. Incidental contact, shit happens.

Speed is going for debate and ratings improvement.

+1 on the brake cover unless somone can elaborate on any safety concerns with said equipment.
