Advise please...

I was looking for a gas tank for trackday use, and found decent one on eBay and bid it.
Unfortunately, I did't win it, but the seller contacted me later and say the winner doesn't want it and I have chance to buy it.

The seller has more than 700 positive feedback and about 10 negatives, so I thought it would be OK. (This was the big mistake...) He informed me shipping cost and I paid total on Paypal on June 21st.

He did not inform me anything if he received my payment until 26th. (He said he was out of town). And, he said confirmed payment and the tank would be shipped on that day.

On June 30th, I sent him a email and asked status. Then he replied next morning(July 1st) and said when Fedex guy was loading boxes, they dropped the box, slipped and step on the box, results denting the tank. So he was asking my phone# and said there are some options for this. I asked simple refund on my paypal account. I even called him and he said his lawyer will make refund on my paypal account in that day.

As you could guess, there was no refund made, so I sent him email again this morning and let him know there was nothing.
He replied F word and asked if I was threatening him. Then I got other mail from him and said I just cost myself another day, and he will make refund tomorrow.

OK, the worst thing I could imagine is happening here. This is non eBay transaction, so we don't have any contract. I paid $$$ and he got it. Now the product is damaged so need refund, but the seller pissed me off. I am going to wait for refund tomorrow, but I bet he may not make it. Now I don't know what to do rather than wait, I would appreciate if you could get me your advice.

:wtf :wtf save all your emails and record everything incase you have to take legal action.....along with your paypal receipts:thumbup

That sucks dude..I've been stiffed on ebay a few times too, it really pisses you off.

I hope you get your payment, the guy sounds like a real jerk. Let us know what happens.

BTW, I know it wasn't a ebay transaction since you really wern't the winner, but doesn't paypal offer protection for something like this? I would go check with paypal, since you paid this guy through them and you didn't get the product.

Just wait a couple of days. Inform PayPal. Save all info and ebay messages. Inform eBay, as that is the source of the transaction. Flood his auctions with the story if nothing happens.

You can get some recourse through PayPal. Here's the Buyer Complaint form It will take a few weeks and the seller has to respond to your allegations. If he has money in his paypal account and they find that you are justified, they will deduct what you are owed and transfer it to your account.

What they said. Paypal is owned by ebay anyhow. That's why they're integrated like they are. Contact paypal and lodge a formal complaint. He had negative feedback for a reason!

Masa, don't wait! that is the ploy. the longer you delay the worst it gets and the trail goes cold. there is an IMPLIED SALES CONTRACT. You aren't sending him money for nothing! Dispute the chargers now. Good luck on getting your money back. I do not think you want this tank, supposed damage (and probably not insured by UPS right?) or deal with this yahoo any longer. It sounds like fraud, and ifso he is a thief.

Yea, don't waste any time. Complain to Ebay and Paypal. Also, I have had bad experiences with Paypal, see Paypalsucks.com. Your money is not safe. Also, don't trust anyone with that much negative feedback. Good luck!

Thanks, Max and xxxmph. I thought that is the ploy too. He can say whatever he wants(like Fxxx this morning) and just not refund to me. WTH...
I should compile email and have report today.

Did you do a direct transfer from an account for the paypal payment? If so, you have less options. If you used a credit card account, just call the credit card company and claim a fraudulent transaction and you should get your money back.

It was direct transfer from my bank account, ouch! Paypal is trying to let people use this method. I don't like it but I used it on this transaction...

The guy made full refund on paypal account today! (It's still pending until the funds have cleared from the guys account though)

Fraud is a significant part of eBay.
I bought a book from Amazon 5, 6, 7? years ago!

A future note, NEVER EVER directly wire the money over paypal. always use a credit card of some kind.

the only reason paypal tries to coerce you to use the direct wire is probably because it saves them on merchant fees.

a credit card is the only way to guarantee you won't get ripped off.
