Wow those are painful to look at. Glad he will be ok. Now hopefully he will remember to always wear gear and remind his friends to as well. Best Wishes on his recovery.

i'm very sorry to hear your son was injured. That said I must say it's refreshing to read your reaction. It sounds like your son has a very supportive father.

How old is he? 16? If so (or close) he should heal quickly.

I'm glad that they did the surgery right away, it sure helps things heal more quickly.

Contact a lawyer. Don't think about "fair", "nice" or any of those words. Think about whether your son has had his life permanently impacted and may have problems the rest of his life. DON'T accept ANY offers or SIGN ANYTHING until you have discussed this with a lawyer your TRUST. The standard is three times medical costs as damages. But get that "FAIR" out of your mind. You have NO idea what the future will be for your son, and being "fair" now is not what you do. And that's why we have insurance....

Above all DON'T make any sudden decision. Think about this long and hard. This lady was happy to LIE about how fast your son was going. Don't be nice. Don't be nice.

Soft tissue knee injuries ( Which is something that often happens in a crash of that nature) take months or years to heal and won't even be obvious till he is back on his feet. )

Let your insurance co. go after her ins. co. for the bike. That is the least of your worries right now; throw the bike in a back corner of the garage & throw a tarp over it & forget it for now.

I'm very happy to hear your son is at least in the recovery stage, but as mentioned= injuries take years to show up sometimes. You should see me limping around w/a cane these days after being run over too many times.

Insist your insurance co. take care of everything; that's what you pay them for, & contacting a lawyer is something you should do immediately. He/she will know your rights better than you do. Start a log/diary of everything you do in relation to this unfortunate accident.

Your time off work, gas, mileage, anything out of pocket you pay for; you should get all of that back eventually. After all, SHE screwed up, not your son...& she's already lied; be very wary of anything coming from her side. I wouldn't talk to her or her attorneys EVER until your insurance/lawyer says you can.

Thanks for all of the advice. I have already setup an appointment with an attorney, turned the bike over to Honda and got an estimate... about $2750 in damages. It will be totaled most likely. The boy gets his stitches out next week. If ever one of us gets another burn I am going to put honey on it immediately as it has antibacterial properties and eases the pain.

I am logging all of the time I have needed to take off due to the accident. I am logging every hour as well as medical supplies that I have had to purchase.

I am am back to work now and am recovering from my time off.... Sounds like other vacations I have had.

Good thing be is young, but bummer on losing out on some good healthy fun at his age.

Wish him the best from barf. Wish the whole family a quick road back to normal.

I'm a little late but if it helps...

You have two separate claims here.
The first is easy, property only.

Property means the following:
The bike
The gear your son was wearing
All of his clothes including underpants
eye glasses (if he wears them)
cell phone (if it was on his person it may have been damaged)

Sit down and make a list. Note the brand name if any of his clothing and research current list price. Same goes for his helmet and gloves and any other gear he was wearing.

As for the bike.
Again sit and make a list:
any mods
last service
tires
any thing to help establish the correct actual cash value.

The second claim is complicated. Bodily Injury claims are settled the moment you sign the bottom line and accept the check. DON"T DO IT!!!!!

Even if he feels all heeled up in 6 months DO NOT SETTLE!! If you have medical insurance and can afford to wait at least one year after healing do so. You want to know if he hurts when seasons change, when he runs, when he rough houses with the dog. It takes at least a year to heal.

In this case a lawyer sounds like a good idea. You need to get your time back also ;)
