Star-gazing teens fall asleep in street, are run over by car

(06-13) 14:22 PDT DANVILLE -- Two teenage boys who fell asleep while star-gazing in the middle of a street in Danville were run over early this morning by a woman delivering newspapers from her car.

The 15-year-olds were trapped for a time under the driver's Nissan Sentra before being extricated by rescuers from the San Ramon Valley Fire Protection District, said Sgt. Phillip Wisotsky of the Danville Police Department.

One teen suffered a punctured lung and a broken bone, while the other youth's injuries consisted mostly of "road rash," Wisotsky said. They were taken to John Muir Medical Center in Walnut Creek, where police questioned them today.

"They said they had gone out into the street to look at the stars," Wisotsky said. "They laid blankets down ... fell asleep and got run over."

The incident occurred at 3:24 a.m. on Ashland Court. The driver, who delivers The Chronicle and other newspapers on the cul de sac, drove over the teens as she was leaving, apparently not seeing them.

Wisotsky said an investigation is under way "as to who is at fault. It is illegal to lay in the street. It is a public roadway and people aren't supposed to sleep on it."
According to Chris Blaser, vice president of circulation at The Chronicle, the driver was a subcontractor delivering papers for a Danville distributor.

"She is very shaken up," he said.

the kids are at fault for being dumbasses but they got their punishment.

the lady is stupid for not paying attention to where she is going. i can't believe it's legal to drive a car not pay any attention to what is in front of you.

Personally I think those kids were a road hazard like a board or a pipe in the road it's 3:45AM it's dark granted she has headlamps but....
I think the parents are at fault for raising kids with NO sense no sense whatsover!

No one I want along at the end of the world.

According to the article the lady was delivering newspapers in the morning, it might have been dark at that time and she might have overlooked the kids passed out in the middle of the court.

Yes that doesn't excuse her but I can see how that would be so easy to overlook especially when it is in a court at that time in the morning.

Did the 15 year olds sneak out of their houses, or did their parents not care that they wern't in bed at 3am? Interesting...I'm glad they were not killed though.

It was almost 4 in the morning, who knows what the lighting is like. I doubt the kids were in the middle of the street. They were probably near the curb when the lady was making a u-turn or setting up to make a turn out of the cul de sac, all the while shifting through newspapers.

well one thing i know from reading barf is if the driver tells the court,' i didnt see him,' its good enough and they let them go. happens every time.

On a normal street, highway, or any other place - I would lay 100% of the blame onto the kids. But this isn't a case where we don't have a high 35 mph speed limit.

This is a cul de sac. That means normal traffic is usually 5-15mph there. After living at a dead end street for years you see that NOBODY ever comes down there, let alone going fast. It's easy to understand the potential to become complacent and assume that you can lay there for hours before the next CAUTIOUS person pulls up slowly(like the rest), and honks the horn at you.

Maybe they got stoned and wanted to check the stars out and passed out. Shouldn't be an issue. If I drove that car I bet 100% I would not have hit them.

This lady also fails on the charge of complacency. Everyday, she's used to ZERO traffic, she's used to the luxury to not have to pay attention, so she lets the guard down.

Either she was going too fast for a dead end street or she wasn't paying attention.


Head up the ass = kids get hurt.

75% of the medical bills paid by her, 25% by parents.
This is my judgement. She should not be off the hook.

Well, dang. I can't figure why everyone blames them deer for collisions on the highway, since obviously, it's not their fault. They're just in the silly road like anyone else that wants to have a picnic, make love, or take a nap.

^^^^^ T-1 it is a fairly reasonable certainty that you will never be in a position to make such judgment calls and that is a good thing.

What do you know from the story?

1. It was 3:24am
2. They were laying in the street.
3. She ran over the top of them.
4. They were not killed.
5. The one boy has minor injury's
6. The second boy has a punctured lung, he will survive.

What you do not know:
1. What they were wearing
2. The color of the blanket
3. The speed she was driving
4. Where in the street they were laying

Now let me ask you this T-1 if you lay down in the middle of the street at night what do you think your reasonable expectation is that you may get hit by a car? Now if you drive down a street at night what do you think your reasonable expectation is that you may drive over someone laying in the street? I will bet you what ever you want to bet that if you lay in the street 1,000 times you will get hit more often than you will run someone over laying in the street haven driven down the street 1,000 times.

Article doesn't mention anything about speed, and not that it makes much difference, but the "as she was leaving" line could imply she was backing out of a driveway when she ran over them on the street. If that's the case it would make more sense why she didn't see them ... doesn't make it excusable, but at 3:30 am I wouldn't be expecting to look on the road directly behind my car as I backed out so much as looking to see if there's traffic coming or not.
