Speeding ticket advice

mackdaddy

Worthless piece of poo
I was on the 580 W yesterday I think around Harbor Way/Cutting Blvd on my 2011 CBR1000RR. The Officer told me I was speeding in excess of 105. I said I definitely was not once & did not argue beyond that. He went back & apparently wrote me a ticket but he didn't have me sign anything nor did he give me a ticket. He said I would receive a notice in the mail.

Is this an elaborate warning? I think not. That sounds too good to be true.

Is there any point in trying to argue I was doing less than 99?

Is a conviction for 5, 10, 15 miles per hour less, yet still speeding a less severe fine?

Do lower speeds increase eligibility for traffic school?

Thanks in advance for your help!

This attorney web site contains some good information on base fines and speed brackets. Keep in mind, substantial fees are added to the base fines. https://www.shouselaw.com/traffic/speeding/basic.html

This seems strange to me. I don't know. Normal protocol would be a ticket issued on scene or a physical arrest if the violation was a felony, and maybe for a misdemeanor. Receiving and signing nothing would normally be a warning, but I don't have an answer for why the officer told you that.

Yes. It would significantly lower the fine if found guilty.

See the attorney web page I linked above. Fines are grouped into speed brackets, but those are just base fines, not all the add on fees.

A person is automatically eligible for traffic school on a speeding charge if they have not attended in the last 18 months, request traffic school, and if the speed is not more than 25 MPH over the posted limit. One might be able to go outside of those parameters at the discretion of the court/judge.

Also, some guidelines that could help. https://www.bayarearidersforum.com/forums/showpost.php?p=2019738&postcount=1

DISCLAIMER: none of this will be used for court purposes. We are here to help, not get your info and screw you. I expect all the LEO's here to adhere to this disclaimer please.

From now on, and we should have addressed this early on, I would like folks who have questions about tickets to provide minimally the following information.

1. section you were cited for
2. city where you were cited
3. your vehicle info (not required, but helps alot)
4. what the OFFICER TOLD YOU
5. what you TOLD THE OFFICER
6. a brief description of the location (ie...lights, what type of intersection, what type of street, etc.....)

When we have this information it greatly helps us understand the circumstances surrounding your ticket and ways we might help you with it.

The OP forgot to mention this from his posting from another thread
"seeing a $900 fine for over 100 I was being extra careful to not exceed that speed."
I'm assuming that he was probably near 100 mph.

Riddle me this.
Not a warning, your ticket will arrive in the mail.

From your other post:

Sooooo play stupid games, win stupid prizes. I was pulled over yesterday on 580 W just south of the San Rafael Bridge. The ironic part is having posted this thread & seeing a $900 fine for over 100 I was being extra careful to not exceed that speed. I wasn't even close yet the officer insisted I was doing 105 at least. I most certainly was not. He was nice & said he wrote I was only doing 99.

Thanks, I guess.

He didn't have me sign anything nor did he give me a ticket. Was this just a warning? Seems too good to be true.

I'll post on the LEO forum for some advice

PS The ironic ironic part is the bridge was down to one lane so the bridge traffic was backed up some. If I had been doing over 100 he probably wouldn't have caught up to me before I started splitting through the traffic & I would have gotten away oblivious to his chase. Ugh

That dude cut you a huge break. Over 100mph is a 30 day license suspension and roughly $200 more expensive.

Last biker I went lights and sirens after who started splitting "and was oblivious" had me show up at his house and impound his bike for a month. So...don't do that.

Take your licks and move on. I've testified at court, had judges amend my break where I gave a reduction in speed and the judge increases the speed up to the highest speed and take people's licenses and increase fines.

Complaint to be filed. Likely recorded the info to fill out the cite at the office. Makes more use of time on the road to stop more violations. That traffic stop was probably done in less than 5 minutes.

Varies by county. All said and done, not including increased insurance premiums, it's in the ballpark of $900.

Do they pay a process server to deliver the ticket? Certified mail?

I thought over 100 was go straight to jail velocity???

No. It's still an infraction if charged with speeding over 100. But at those speeds, depending on other driving factors, an officer could much more easily articulate the elements for misdemeanor reckless driving, which could result in jail and vehicle impound.

Had a friend who was out on a ride and just ripping waaaaay over 100mph on a GSXR and did not know LEO was chasing him......he pulled over at a store to allow us gentler folks to catch up and LEO was pissed....pulls in, draws firearm, syas get on the ground and away friend goes to jail.....it was WAAAYY more expensive than 900 bucks.

Curious how the officer got the rider's attention...folded mirrors and all... also wonder where was the stop initiated...

Glad that rider is off the streets :thumbup

california has always hit the hardest with speeding violations. Once I was popped for 103 in 75, I walked out of court with zero points, a smile and -$75 in my back account. I didn't even go to fight it, they offered it up front. Then again, it wasn't in California.

Years ago during WBSK, it cost me $475 for 80 in a 55.
