U.S. Sen. Mike Johanns (R-Neb.) introduced the bipartisan Farm Dust Regulation Prevention Act as amendment No. 2212 to S. 3240, the Agriculture Reform, Food, and Jobs Act of 2012, more commonly known as the 2012 Farm Bill. U.S. Sens. Charles Grassley (R-Iowa) and Claire McCaskill (D-Mo.) are cosponsors. The amendment would bring much-needed certainty to the off-highway vehicle (OHV) community by exempting rural "nuisance dust" from U.S. Environmental Protection Agency regulation and allow states and localities to regulate it.

The vote for this amendment is expected early next week!

If the exemption of “nuisance dust” does not occur, this regulatory restraint may lead to a de facto ban of OHV use on racetracks, in designated recreation areas, on trails and even on private property all across this country.

On Dec. 8, 2011, the U.S. House of Representatives voted to pass H.R.1633, the Farm Dust Regulation Prevention Act of 2011. H.R. 1633 passed by a vote of 268 - 150. This bill is the companion bill to amendment No. 2212. The American Motorcyclist Association and the All-Terrain Vehicle Association urged representatives to vote Yes on H.R. 1633.
In its review of the National Ambient Air Quality Standards (as required every five years under the Clean Air Act), the EPA staff and its Clean Air Science Advisory Council recommended considering the option of a much tighter Particulate Matter (PM) standard for "nuisance dust," commonly known as farm dust.

The EPA continues to bring this issue forward with each new administration. This bill attempts to prevent future action toward a tougher PM10 standard. The AMA and the ATVA thank the House for passing H.R. 1633 and urge the Senate to pass amendment No. 2212.

Of course, "nuisance dust" in some rural areas carries a huge range of real toxins, from dioxin to friable asbestos, farm insecticide, nitrates, sulfates and a host of other toxic shit. But dust can't harm anyone, ask Steve McQueen.

Do you have enough understanding of this to debate that? Here in lies the issue, our community, yes street and dirt have absolutely no idea what we are up against when it comes to the EPA and its Eviro-Nazi stand with greenies.

So you turn a blind eye today, tomorrow you show up at Infinion and the entire site is shut down with Superfund site signs because it is now dubbed a toxic waist land by the EPA
