I would recommend contacting an attorney. Otherwise it's you against their insurance company.

Take care of yourself. Get the care you need - medical and legal.

The two things you are going to want to understand: bodily injury and subrogation. Your bike's bodily injury policy usually doesn't cover you. Sometimes it will cover your passenger. Since you have Medicare, the health bit is covered. Use it.

When insurance companies payout for damages they want to recoup the cost from the real at fault person - this is subrogation. This is where I'd want a lawyer in the mix. Insurance is there to make the wronged party whole and a good lawyer will help make it go well for you.

Glad you were not seriously hurt and best in your recovery. Do get checked out though, you don't want to find something later that was a result of this accident.

Just thinking out loud,er ,typing. Wouldnt Medicare want to get reimbursed for cost too. Just like any other insurer. I dont have any experience being that Im only a spry 60.

A kid I knew in high school caused real damages to an entity and the parent’s homeowners was dinged. Sometimes those have high deductibles. If his bike was valuable and he lives up there you’re probably good with that police report, but it also makes the lawyer necessary because they will have one.

You have an impressive stable. Maybe match up that value with commensurate insurance. Report to your insurance right away. They might fight for you.

While you have liability only, it would still be pertinent to contact your insurance to see if there's anything they can consult you with, they may possibly assist you in getting in touch with the parent's home insurance party.

Otherwise, as others stated, contact an attorney. When you say you might have a broken arm, did you go to the hospital? You may also want to consider if you are injured, the possibility for being out of work for x amount of time that would prohibit you from actually seeking/performing work and there is restitution behind that.

Since you're relatively okay and what you're asking is more than reasonable, I'd try talking to the kid about covering damages. Definitely talk to your insurance asap, but maybe give them a chance to make it right before going nuclear with a lawyer.

I was also thinking this but I wouldn't talk to the kid, I would talk with the parents. If you are to work out something amicably outside of getting an attorney, it's win/win for both of you.

Parents - lowers homeowner insurance rates, pays out of pocket.

You- no attorney fees, get something faster.

Obviously I would have something in writing signed by both parties. I went through something similar to this in my teenage years. One party would have collected more if they had just dealt with me privately but everyone's comfort level is different.

you can make 1 phone call to an attorney in between naps. it will take 20min, then you can nap again. things generally will go better for you if you get the ball rolling now instead of later.

of course, the attorney is also going to tell u to go to the doctor.

My guess is the insurer will seek remibursement from the parents and also try to subrogate anything he might get on the medical side.

OP I would definitely consult a lawyer. I used Scotty Storey's wife Angela for my accident six years ago and she was awesome. Very reasonable fee too.

Jesus Fucking Christ, this is the right answer. Grow some balls and learn to deal with the people you encounter in life. Didn't immediately get what you want? Talk to them again. If you get to a complete impasse, then consider contacting a lawyer...

Contacting a lawyer will cost you time and money and should be viewed as a last resort, not your first knee-jerk reaction to every minor problem you encounter in life :rolleyes
