The Santa Clara County Office of the Sheriff has arrested Saratoga resident Robert Paul Schiro in connection with last year's hit-and-run collision on Highway 9 that left competitive cyclist Ashley Jackson with permanent brain damage.

Schiro, 70, has been charged with felony hit-and-run with a possible charge of driving with a suspended license added at his arraignment, said Lt. Skip Shervington. Schiro was being held at the main jail on $100,000 bail as of Thursday afternoon.

Schiro was arrested at his office in Santa Clara where he runs RPS Properties, a property management business.

The arrest comes almost a year to the date when the collision occurred.

Jackson and her boyfriend, David Nelson, were headed home on their bicycles on April 19, 2009, when a silver BMW 700-series hit the cyclists and threw Jackson to the ground. The driver had stopped for a moment but then took off, Nelson said at the time.

Jackson suffered serious brain trauma and was treated at Valley Medical Center.

Jackson still suffers from double vision and a damaged optic nerve in her left eye, Nelson said. He said that the left side of her body is still much weaker than the right side.

Nelson said the arrest of Schiro is a relief although it doesn't make Jackson's physical issues any better.

"She's still recovering," he said. "We're talking about a traumatic brain injury.

"We don't know when or if it will get any better."

I'd like to know how they tracked him down.

Article says she was riding with her boyfriend, I'm assuming he wasn't involved in the accident and was able to get the license plate before the dummy took off.

It would suck to go to prison at the age of 70, but he deserves it. If only he had stopped, his punishment wouldn't have been as severe. Now you get to die in prison... :rolleyes

You think he's going to die in prison because a hit & run with injury? This person will not do more than a few years, if that.

Duty to Stop at Scene of Accident

20001. (a) The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.

(b) (1) Except as provided in paragraph (2), a person who violates subdivision (a) shall be punished by imprisonment in the state prison, or in a county jail for not more than one year, or by a fine of not less than one thousand dollars ($1,000) nor more than ten thousand dollars ($10,000), or by both that imprisonment and fine .

(2) If the accident described in subdivision (a) results in death or permanent, serious injury, a person who violates subdivision (a) shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not less than 90 days nor more than one year, or by a fine of not less than one thousand dollars ($1,000) nor more than ten thousand dollars ($10,000), or by both that imprisonment and fine. However, the court, in the interests of justice and for reasons stated in the record, may reduce or eliminate the minimum imprisonment required by this paragraph.

Well first the prosecutor will need to press the appropriate charges and not plead them down. If by some kind of miracle that happens, then he will be judged by twelve of his "peers", yeah.... I doubt he will see a day in prison.

He's looking at 4 years in prison if I read that right. If he does not cut a deal with the D.A. and gets the FULL sentence of 4-5 years he can serve 2 and parole the rest. That's the best case. More likely will be a few years probation or less than a year @ county.

More than a year after an accident that left a competitive bicyclist permanently brain damaged, Saratoga motorist Robert Schiro has pleaded guilty to felony hit-and-run and is facing a year in county jail.
Schiro, 70, initially denied that he had been behind the wheel on April 19, 2009, when Ashley Jackson and her boyfriend, David Nelson, were hit while biking on Highway 9 in Saratoga.
Schiro's car was impounded shortly after the accident, but it took the police nearly a year to gather enough evidence to charge him.
On Thursday, after meeting with his attorney and Superior Court Judge Rene Navarro, Schiro pleaded guilty to hit-and-run causing serious permanent injury or death, a felony that carries a maximum sentence of four years in prison. He also pleaded guilty to two misdemeanors, driving with a suspended license and hit-and-run involving Nelson, who was not seriously injured.
Assistant District Attorney Carlos Vega said Schiro is likely to get a year in county jail when sentenced on Oct. 5.

The guy who hit and killed my dad who was in a marked crosswalk only got 6 months.

Not a lot of incentive to obey the law.

Fucking joke. How any judge can look at that, have the ability to give him 4 years and only give him 1 is beyond me.

Not a lot of incentive to obey the law.

Serious question and please don't take it the wrong way because I am not sure of the details of your Father's death (my condolences as well) but since you brought up accidental death caused by inattentiveness(I think you did anyway) what do you think Mesherle should get?

In my dad's case he was walking across the street in a marked crosswalk. A guy driving a car with the defroster removed decided it wasn't important enough to unfog his windows and drove down the street without having a clear view of the road. He struck and killed my dad. He got a whopping 6 months for his negligence, had no insurance and not a penny to his name.

Mesherle case I won't comment on BARF. I will discuss it in person but I don't want to open that up again here in this forum.
