Ex left his Moto, what can I do?

Hi All. My ex-boyfriend left his 2000 R1 in my garage when he went to visit his kids out of state. After a couple of weeks I found out what a LIER he had been during our relationship, that conversation led to others, found out more bad stuff, long story short he said he would send me the title. Since then his phone has been disconnected. Yeah, still no title in the mail. I looked into it at the DMV and it seems like I can do a request for a Lien Sale, but it asks how much I charge per day for a total owed...? When I called the DMV the nice lady looked up the licence plate number and he never registered it. I also asked her to cross ref the VIN (to make sure he didn't steal the plate, or anything else bad, but she said the VIN matched the description against the plate and that it had been released from the seller, so at least it wasn't stolen...
I can't ride it, cuz I don't have insurance on it and I can't get insurance on it without the title. Anyone done a Lien Sale who can maybe give me a bit of insight on how to use it in my situation? Obviously he doesn't owe me for towing nor work done on it. Storing = kinda, he is gone, moto is not.
Suggestions? Legal ones preferred, LEO forum and all :teeth

Digital camo vinyl over red/white/black plastics. I'm a newbie trackster, wanna SV650 for that, I'd crash hard on an R1 at the track, it would be UGLY. It has been down a couple of times, tank has knee dents, scrapes on the levers. It WOULD be a great track bike, but not great for my first track bike. I can't sell her without the title... grrrrr

sell everything but the motor and the frame, cause that is still his? At least it won't take up so much space.

I wonder how legal that is. It is an abandoned vehicle. If you have documented attempts to contact him... Has it been a week, or a year?

Haha! A week? I'm not THAT much the bitch. He left just over 2 months ago.

Can't remember the exact process. But you have to...

notification of lien via ceritied letter to last address on the registration.

List storage rate $40 a day.

If property is unclaimed for 30 days you can file for the title.

Contact "Pats lien service" in Livermore. They will take care of the paperwork. I think they charge 75 bucks give or take.

There are several factors since the bike was never put in his name. I would work two angles. One that you file a lien and the other that is was abandoned. The key with the lein is if the previous owner tries to pull a fast one and just say it is in his name he wants it back. Using the abandoned item is just a backup plan and may be easier to deal with paperwork wise and easier to prove since you don't have anything in writing about storage or money that he owes you.

If the previous owner filed the ROL (which it sounds like they did), I'm pretty sure they can't just take it back.

Even with the lien sale prior registration fees will be do.
Attach a value to rent. Give him another 4 weeks. Add late fees and cost of lien service.

Don't take the advice from this forum for one. Some know the laws here fairly well, but if you screw this up, you could be in a world of hurt. Consult an attorney, and see what they say. It may cost you a hundred or two, but at least you'll know what you can and can't do legally.

Worst case scenario, put it out by the street, call the local parking enforcement and tell them it's been abandoned, They'll handle all the nastiness that might ensue.

Edit to add: I hate telling people to seek legal advice, but I think you should in this case.

If you want it, or you want to sell it, do a lien sale. Been there, done that.

If you want to get rid of it, roll it outside on the sidewalk with the key in it.

I will contact that lien co and get their advice, I do not have a lawyer at this time. Snapper has dibs on the bike when/if I can get the title clean n clear. She is with AFM Team Uniform Speed and it would make a great daily ride for her and advertisement for them.
