Carnegie SVRA Expansion Fund

Folks, please help.

It seems there is sparse information and misinformation about the status of the Carnegie SVRA expansion. The AMA, Blue Ribbon Coalition, Carnegie Forever and CORVA are involved in these issues. We are trying to coordinate those efforts.

The fact is at least three groups have filed to challenge the general plan approval of October 2016. I could speculate that the same folks are behind this and much of the anti OHV activity that we deal with.

The three filings I have seen are
1 Notice to file suit; Connolly for Connolly
2 Notice to file a “Petition for Writ of Mandate”; Mooney for “Friends of Tesla etc”
3 “Writ of Mandate”; Smith for SPRAWLDEF

Mark Connolly is married to Celeste Garamendi; very powerful political families. I am concerned that politics may trump justice in this issue. I am concerned that deals could be made without our and the public's knowledge or comment.

A legal avenue, "intervener" status, exists such that we can be part of the deliberations.

I speculate that those who oppose OHV are older, financially secure, retired and eliminating our riding areas are a major focus of their lives. Funding their actions does not seem to be an issue. Speculating further this group seems to want to designate as much land as possible as an exclusive hiking environment. They appear to be using the Alameda County Parks department as a tool to this end.

Funding for the OHV community is difficult. The organizations we already support have committed their revenues to other projects.

Will you guys help? We need a lawyer to file intervener papers. CORVA is currently working with State Parks on similar issues and has volunteered to bring experienced counsel to our aid.
100 people donating $30 would get us going. In my opinion, this is the first set of many challenges the anti OHV folks are going to create.

Budman and BARF are kicking this off with a $500 donation.

Select "Carnegie Legal Fund" in the dropdown menu in "Categories" if necessary, and just for fun, put BARF in the "Comment" box.

Started riding there in the 70's, taught my kids to ride there in the 90's. It's a pleasure to donate to a worthy cause that has provided so many good times.

The OHV Commission meeting is Friday. This is in the agenda:
CLOSED SESSION at approximately 12:30 to discuss litigation. Conference with legal counsel to confer with and receive advice regarding litigation that has been initiated formally. [Government Code § 11126(e)(2)(A)]:

Sustainability Parks Recycling and Wildlife Legal Defense v. California Off-Highway Motor Vehicle Recreation Commission and California Department of Parks and Recreation
[Case No. 34-2016-80002492]

Friends of Tesla Parks, et al. v. Department of Parks and Recreation, et al. [Case No. 34-2016-80002494]

Connolly Ranch, Inc. v. Department of Parks and Recreation, et al. [Case No. 34-2016-80002495]

County of Alameda v. California Department of Parks and Recreation, et al. [Case No. 34-2016-8002496]

(2) CLOSED SESSION1 may be called to discuss pending and/or potential litigation as permitted by Government Code section 11126 et seq. Conference with legal counsel to confer with and receive advice regarding pending litigation when discussion in open session would prejudice the position of the Commission. [Gov. Code § 11126(e)(1) & (e)(2)(A)].

Just signed the contract with the attorney.

BARF and CORVA are the official petitioners... or freedom fighters... or peeps on the line to pay the attorney. This is a first for us and likely not the last given what is going on in the OHV system.

Do we need more? Is it too late?

Thank you, we have counsel on retainer on current funds and good faith.

And no, it is not enough. Celeste and the Haters spend tens of thousands. Of course, her husband is attorney, representing his ranch as one of the plaintifs, or somethiing.

The haters have almost unlimited funding. We need to gather every cent we can.
