Bike on crosswalks or pedestrian pathways while dismounted

Hello all,

I have a question for you. Is the situation depicted in the picture legal?

It may be just advertising shoot, but this is something I'd like to know if I could be cited doing something like this, say, on Market St. or wherever else is pedestrian only walkways.

Also, I also ask if the situation depicted above would be different if:

a. rider still dismounted, but engine was on (it's a Ducati, so figure loud(ish).

b. engine off, but rider with helmet on

c. engine off, helmet off, but no smile/no cute girl.

One night around 10:30PM, I ran out of gas on the 380 freeway, reached down to turn my petcock to reserve, and duh, I was already on reserve. So I coasted to the exit for El Camino Real, where I knew there was a gas station down at the next intersection. I was pushing my bike down the street, essentially where a bicycle would ride, because I thought it might look suspicious pushing it on the sidewalk.

Not more than about 5 minutes, got lit up by the popo. I told him that I just ran out of gas and was pushing it to the gas station. He ran my ID, reg, checked me for odd behavior....asked me why I didn't have my lights on, which I told him, I was afraid that my battery would be dead, for the time it would take me to push it to the gas station (it's kind of a way down to the gas station- but at least it's flat!).

Finally decided after about 10 minutes that I was legit, and told me to push it along the sidewalk until I got to the intersection and then cross the street by pushing it in the crosswalk. For safety.

Oh, man...that would be the perfect excuse, run out of gas. I'm always tempted to take the bike down some pedestrian pathway for a cool scenic picture or something like that.

The person is still the "Driver" and has to follow all the rules of the road as other vehicles. If it was for a legitimate reason, such as a break down out of gas, it would probably be overlooked. It doesn't matter if the vehicle is running or not.

Driver

305. A "driver" is a person who drives or is in actual physical control of a vehicle. The term "driver" does not include the tillerman or other person who, in an auxiliary capacity, assists the driver in the steering or operation of any articulated firefighting apparatus.

The most common use of this is when a car breaks down and the person is pushing it and trying to steer the vehicle and the vehicle gets away from them and crashes. That person is still the driver of the vehicle that got away from them and crashed. They would be listed as the driver in the crash report.

i do not care what the law says...if i have to "walk" my moto i will push it where i am safest at.

but then not many sidewalks up here where i live and play. :party

I've just missed the light at a u-turn lane before, at a big intersection with several-minute cycle times. There was a crosswalk right in front of me, so as cross traffic got their turn, and the pedestrian lights indicated OK to cross, I killed the engine, dismounted, and walked my bike across to the far curb, where I left the crosswalk, remounted, and rode away.
