The U.S. Senate is considering S. 3525, the Sportsmen’s Heritage Act of 2012. The American Motorcyclist Association supports many provisions of the bill. However, the AMA is concerned with certain provisions that pose deleterious threats to responsible motorized recreation on private and public lands.

The AMA opposes as written several provisions in the bill. Title II, Sec. 201, would effectively create a new definition for “aquatic habitat.” The term is defined broadly and includes “any areas on which an aquatic organism depends, directly or indirectly, to carry out the life processes of the organism, including an area used by the organism for spawning, incubation, nursery, rearing, growth to maturity, food supply, or migration.” Additionally, the term includes areas adjacent to an aquatic environment that “serves as a buffer” or “protects the quality and quantity of water resources.” One could argue that all of the land our members ride on falls under this definition.
Moreover, the AMA opposes Sec. 204 and Sec. 207 because the bill mandates that the federal Bureau of Land Management and U.S. Forest Service cooperate to “conserve” “aquatic habitat” as broadly defined in Sec. 201. This will impose broad restrictions on all BLM/USFS activities and be a priority over the Federal Land Policy and Management Act’s multiple-use requirements.

Additionally, Sec. 204 allows projects to be automatically “approved” should the secretaries fail to respond to recommendations within 180 days. Besides allowing for automatic approvals, the bill delegates authority to the secretary to “promulgate such regulations” as “determine[d] to be necessary to carry out this subtitle” (Sec. 210).

If S. 3525 becomes law, as written, anti-access advocates and the administration could usurp congressional authority by administrative fiat concerning the disposition of public lands. This bill has far-reaching implications because the BLM/USFS manages millions of acres of public land nationwide.

The AMA needs all its members and OHV enthusiasts to write their U.S. senators today. You can follow the “Take Action” option to send a pre-written email directly to your senators urging them to oppose any usurpation of congressional authority with regards to public land designations.
Send a pre-written email to your senators now and let them know you oppose S. 3525, as written, and to amend Title II.

Thank you for writing to express your opposition to the "Sportsmen's Act of 2012" (S. 3525). I appreciate the time you took to write, and I welcome the opportunity to respond.

As you may know, on September 10, 2012, Senator Jon Tester (D-MT) introduced the "Sportsmen's Act of 2012." This bill is an amalgamation of more than a dozen other bills intended to promote access to hunting and fishing on public lands as well as support habitat and species conservation. For example, the bill seeks to dedicate 1.5% of all Land and Water Conservation Fund spending to securing easements or acquisitions that improve access to public lands. Additionally, the bill supports various programs to fund fish and bird habitat conservation, such as reauthorizing the North American Wetlands Conservation Act, which provides incentives to private land-owners to protect critically important habitat for migratory birds and wildlife on their property.

While I support efforts to improve access and recreation on public lands as well as the bill's conservation efforts, I do not agree with all provisions proposed in the bill. In particular, I do not support its proposed exemption to the Marine Mammal Protection Act to allow for the importation of polar bear trophies that were taken in Canada prior to its protection under the Endangered Species Act. You should be aware that I opposed a previous iteration of the bill, which would have allowed the possession of loaded firearms on Army Corps of Engineers-managed lands.

On September 22, 2012, I joined a majority of my colleagues in voting in favor of cloture on the motion to proceed to S. 3525. Voting for cloture indicates a desire to proceed to debate on the bill, but does not necessarily indicate support for or opposition to the legislation itself. A final vote on S. 3525 will occur when the Senate comes back in session. I appreciate hearing from you and will keep your thoughts in mind when the bill comes to the Senate floor for a final vote.

hey man, try to come up with a better way to articulate you're frustrations here, this is a public place. with the way your post/thread is written (or copied and pasted), it makes it sound like you are affiliated with the AMA. calling the senator a "lying Biatch" could cause a lot of problems for the AMA and damage their credibility.

After all it is a AMA Sponsored CLUB now and the crap and shit slinging going on here is enough to embarrass anyone.
