So, I was under the impression that if your bike is older than 2013 , having an aftermarket exhaust is legal. Am I wrong?

Not a LEO, but it depends on the system. There are some that are too loud etc. 2013 and before don't have to be labelled a CARB approved system.

2014 and beyond it cannot be changed without the system being CARB compliant.

Riddle me this.
27151 and 27150 CVC say you can't modify your (motorcycle) exhaust to amplify or increase the noise emitted by the motor of the vehicle so that it's over the legal noise limit, which is 80 decibels for anything after 1985.

27156 says you can't modify any of the emission control systems unless the part you swap it with also meets the emissions regulations.

There is a strong chance that if your exhaust is not stock, it's illegal. And as of January 2019, it's a non-correctable ticket that's near $1000, and you still have to get it fixed.

the $1000 is what the fine can be "up to", the real fine would be much lower for first time offenders

Hopefully AB390 can return this to a fix it ticket.

Every motorcycle I own violates the law with respect to this lol

Then I sincerely hope you never write anyone up for it. :ride

An officer's belief that it sounds too loud is sufficient.

It may be that physicists have established definite standards of loudness of sound and means for measuring it, but this does not mean that such laboratory operations must be carried out by traffic officers on the highway where violators of this statute must be found and the evidence against them obtained.
...

We conclude that the words "excessive" or "unusual," when viewed in the context in which they are used are sufficiently certain to inform persons of ordinary intelligence of the nature of the offense which is prohibited, and are therefore sufficient to establish a standard of conduct which is ascertainable by persons familiar with the operation of automobiles.

I got a loud music infraction (important bc it was the reason for the stop and subsequent drug arrest) to stick by showing the judge a map and where I was able to hear the music... similar thing

I don't like laws that are selectively enforced. A friend was pulled over. As he was talking to the officer, another bike went by and blipped his throttle as acknowledgement. Officer says to my friend, " I could give him a ticket for "Spirited Riding" WTF??? So, if I'm listening to NIN and bouncing around in my seat I can get a ticket? This kind of stuff is just harassment, full stop.

You would be blown away if you knew just how many CVCs were regularly violated. :laughing

Maybe I’m not understanding your story, but an officer can only be in one place at a time. If he’s already on a stop, he’s not likely to abandon that stop for another unless there is some serious risk to public safety from the other driver.

Selective enforcement is a fact of life. I doubt you’d prefer the alternative where everyone gets a ticket every time they violate the law.. Maybe the government should just install an OBD2 reader in every car and mail the tickets out every time it reads a violation....

I'm just saying that this officer seemed to want to impress that he could pull someone over for a ridiculous reason. I don't mind getting a ticket that I have earned. I just don't like the petty crap that sometimes constitutes a violation.

Or perhaps he's just explaining it to you so that you understand for future reference that what that other rider just did is a VC violation. :dunno

Consider it his version of food for thought. :2cents

I forget the exact stat but it’s something like “the average California driver breaks the vehicle code once every 3/4 mile” or maybe it was every 3 miles. Either way you can pull anyone over if you just wait long enough.

As someone who lives near a busy street, I really like excessive noise laws and wish they were enforced more. I shouldn't be able to hear a car or bike from half a mile away.
