Dude...Wheres my ticket???

okay...this isnt related to bikes...but im pretty damn curious what the hell happened to my ticket.

so on dec. 1 2004...my dumbass was speeding 110 on the 87 freeway near santa teresa. when you have a fast car you wanna go FAST sometimes....this was one of the times i decided to punch it. 3 am. no cars...so i said... what the hell. to my luck there was a chp posted in the exit somewhere and clocked me at 110 plus. he finally caught up to me near the 280/87 junction. blah blah blah...issues me my ticket...thats the end of my night.

so 3 months pass by and no ticket yet...so i went to the local traffic court to check up on it. not yet processed. so they tell me to come back in 2 weeks. went back...no ticket... then another 3 weeks after...no ticket... i still havent received my ticket and its been almost 7 months. do you think they just dropped my ticket? what should i do? it doesnt show up on my license or anything and insurance is still the same.

You have found the loophole of the traffic court. Alot of things can happen to a ticket after it is written.

1. did the cop remember to turn it in
2. did the cop lose it
3. did the police records department lose it
4. was it actually sent to the court from the police dept.
5. did the court lose it
6. did some court clerk just not enter it

so many things can happen to a ticket. They are LOST all the time between the cop and the court.

Keep on it, but my learned experience is that once a few months go by and its not been entered, its in the interest of justice not to enter it. The court does actually have a set amount of time it can be entered...if it's not, then its not a good cite.

Call the courthouse in the jurisdiction where you got it and ask what the time limit is to have a ticket entered.

You can check the status of your citation without calling or personally visiting the courthouse. Provide, at least, your citation number, including all letters and numbers. Providing your name, driver license number, and date-of-birth can help, too.

Generally, someone will check incoming emails daily and responds to each one.

If previously lost or misplaced by the "system", usually a citation can be entered/processed up to one year after the issue date.

It probably went over to the DA's office for review. Since it is a misdemeanor, they have the option of giving you a trial in criminal court or reducing it to an infraction and forwarding it to the traffic court. I would just wait and see, rather than stirring it up. As long as you are not getting warrant notices, you should be golden.

I have had a few friends whos tickets have been misplaced never to surface . would be a nice thing to happen to you on this one especially since the speed is over 100 . Good luck either way but i wouldnt say much until you get a notice

I know in Contra Costa County the volume of citations have increased so much over the past 5 years, that the courts cannot process them quickly. I have gotten notices saying my court date has been continued for 4 weeks. Hoping for a lost one, no such luck.

Check up on it every once in a while, DON'T GO too postal on it though.... . I had a ticket surface on me after a year and a half. I couldn't renew my license until it was paid.
